Liputan6.com, Jakarta Italian luxury sports car manufacturer Ferrari has lost a legal dispute against Malaysian beverage company Sunrise-Mark Sdn Bhd over a horse logo.
The feud between the two companies stems from the use of horse images on their respective products.

Violating exclusive rights
Ferrari considers the Wee Power logo to infringe on the exclusive rights to its globally recognized trademark.
In addition to questioning the use of horse images, Ferrari also considers that the word “Power” has already been rejected in trademark registration, while the word “Wee” is considered too common to be distinctive.
On that basis, Ferrari sued Sunrise-Mark and applied to have the Malaysian Trademark Registrar's decision cancelled.
However, the Kuala Lumpur High Court dismissed the suit.

No brand resemblance
As reported by Free Malaysia Today, Justice Adlin Abdul Majid stated that the Wee Power logo bears no resemblance to the Ferrari trademark.
In the ruling signed on May 30, 2025, the court noted that the only similarity between the two is the use of a horse image.
“The plaintiff's mark is a device mark featuring a prancing horse, while the defendant's mark contains two horses standing opposite each other,” reads the court ruling.
In addition, the Wee Power logo is considered to have other elements that distinguish it, such as a large ‘W’ between the horses' heads and the words ‘Wee Power’ below it.
Consumer confusion
Judge Adlin also emphasized that there could be no confusion among consumers as both companies operate in completely different sectors.
“The plaintiff and the defendant operate in different industries-the plaintiff in luxury automotive, and the defendant in consumer goods,” Adlin said.
He added that the average consumer would not consider the Wee Power energy drink brand to be similar to the Ferrari luxury car brand.
Additionally, the court ordered Ferrari to pay the legal fees incurred as a result of this lawsuit.
