The Macrons are seeking a jury trial on 22 counts related to claims made by Owens, including in an eight-part podcast series titled "Becoming Brigitte."
Macron's lawyer, Tom Clare, of the law firm Clare Locke, which has won several high-profile libel cases, told the BBC's Fame under Fire podcast that Brigitte Macron found the claims "deeply disturbing" and a "distraction" for the French president.
“Expert testimony will come out that will be scientific in nature.” He did not reveal what nature the testimony would take, but said the couple were prepared to demonstrate fully, “both generically and specifically”, that the claims were untrue.
“It is a process that she will have to subject herself to in a very public way,” he said.
“But she is firmly resolved to do what it takes to set the record straight.” Photos of Brigitte pregnant and raising her children would be presented, he added.

Candace Owens Controversial Statement
As reported by The Guardian, Candice Owens has been one of the most vocal proponents of online theories claiming that Brigitte was born male, stole a female identity, and has continued to deceive the public ever since.
Many theories claim that the first lady was born a man named Jean-Michel Trogneux – who is actually Brigitte's brother.
In March 2024, Owens even wrote on X (formerly Twitter) with the bold statement, "I stake my entire professional reputation on the fact that Brigitte Macron is actually a man."
This statement became one of the main triggers for the lawsuit filed by the Macron couple.
In addition to allegations regarding gender identity, Owens has also spread other equally controversial claims.
These allegations include allegations that the Macron couple are consanguineous and committed incest, and that Emmanuel Macron was elected president of France by the US spy agency, the CIA.

Brigitte Macron Scientific Evidence
In response to these serious allegations, Brigitte Macron plans to present "scientific evidence" and "photographic evidence" in a US court.
This evidence aims to definitively prove that she is a woman, refuting the claims made by Candace Owens.
The Macrons' lawyer, Tom Clare, said there will be "expert testimony that will come out that will be scientific in nature" as to Brigitte's biological sex, adding that the couple is prepared to prove she is a woman "both generically and specifically."
While he did not specify the exact terms of the Macrons' evidence, one possibility raised was the presentation of photographs of the first lady pregnant and raising her children. Clare told the BBC that such photos "existed and would be presented in court where there are rules and standards."
Possible evidence includes photographs of Brigitte Macron during her pregnancy, family records, and testimony from relevant experts.

Candace Owens's lawyers have filed a motion to dismiss the lawsuit, arguing that the case is a politically motivated attempt to suppress free speech.
Owens argues that her statements are protected by the First Amendment to the US Constitution, which guarantees the right to free expression.
Owens's legal team also argues that the Delaware courts lack jurisdiction over the case and that defending there would cause significant financial hardship for their client.
The claim that she was born male first went viral in France in 2021.
Brigitte and Trogneux won a defamation case against two bloggers, Amandine Roy and Natacha Rey, but an appeals court later ruled that the case did not fit the legal definition of defamation.
Brigitte Macron had previously won a defamation case against the two bloggers in France in 2024, but the ruling was overturned on appeal in 2025 on freedom of expression grounds.
