The settlement aims to compensate millions of individuals and businesses who purchased BCBS insurance policies, as well as healthcare providers who treated BCBS patients.
While BCBS denies any wrongdoing, it agreed to settle the lawsuit to avoid the risk and expense of prolonged litigation.
The total settlement is $2.67 billion, with approximately $1.9 billion to be distributed to class members after deducting attorneys' fees and administrative costs.
The distribution process will involve sending payments via various methods, including paper checks, prepaid debit cards, or electronic payments, to plaintiffs who have filed valid claims.

Background to the Blue Cross Blue Shield Lawsuit
The class action lawsuit against Blue Cross Blue Shield was first filed in 2013, alleging that more than 30 BCBS insurance plans violated antitrust laws.
The lawsuit specifically alleged that 35 Blue Cross Blue Shield health insurance plans agreed not to compete with each other in the sale of health insurance and the administration of Commercial Health Benefit Products.
They were also accused of agreeing to additional measures to limit competition in the market, potentially increasing premiums and reducing customer choice.
Although Blue Cross Blue Shield denied all allegations of wrongdoing, they chose to settle.
“This settlement ends a long-running legal challenge to the Blue Cross Blue Shield Association license agreements and related rules,” a company spokesperson said in a 2024 statement upon reaching the agreement.
“We deny the allegations made in the lawsuit. However, to reach a settlement and put years of litigation behind us, we have agreed to make some operational changes and a monetary payment to the provider class involved in the case.”

Key Details of the Blue Cross Blue Shield Settlement
The settlement was a staggering $2.67 billion.
However, after deducting attorneys' fees, administrative costs, and other expenses, approximately $1.9 billion is expected to be distributed to eligible class members.
This settlement agreement was officially reached on October 16, 2020, after years of complex legal proceedings.
As an integral part of the settlement agreement, Blue Cross Blue Shield also committed to implementing changes to certain business practices.
These changes are specifically designed to increase competition in the health insurance market, providing long-term benefits to consumers.
Eligibility and Claims Process
Individuals and companies eligible for payment are those who purchased or enrolled in a BCBS insurance policy between February 7, 2008, and October 16, 2020.
The claim filing deadline for customers expired on November 5, 2021.
It is estimated that approximately 6 million claims have been filed.
Individual payments will vary, influenced by factors such as the length of their insurance coverage, the amount of premiums paid, and whether their plan is fully insured or self-funded.
Initial estimates indicate an average payment of approximately $300 to $333 per valid claim, although the exact amount will vary, and payments under $5 will not be issued.
Payments will be sent via the method the claimant selected when filing the original claim, including paper checks, prepaid debit cards, or popular electronic payment methods such as PayPal or Venmo.
Initial distribution of payments to valid claims is scheduled to begin in May 2026, with notices of claim determinations sent on a rolling basis via email or postcard.
